The 2018 Farm Bill established a federal hemp program. Each state has their own rules. 

CBD is legal in Texas as long as the Delta 9 (D9) THC content is 0.30% or less on a dry weight basis. Smokable products must be manufactured out-of-state, but are legal as long as D9 content is within the legal limit of 0.30%.
